South Dakota 30 Day Notice to Vacate | Month-to-Month Lease

The South Dakota thirty (30) notice to vacate, in connection with Section 43-32-13, is a notice that is used to inform a tenant of the landlord’s intention to terminate the monthly rental agreement. The notice provides the recipient with thirty (30) days to vacate the rental unit. If the tenant does not move out by the end of the 30th day of the notice period, the landlord can sue them for possession of the rental property.

Note: This notice can also be used by a tenant to inform the landlord of their intention to end the lease agreement.

How to Write

Step 1 – Put the date in DD/MM/YYYY format in the “Notice Date” field.

Step 2 – Write the full address of the rental property/unit. In the “To” section, enter the name of the tenant.

Step 3 – Fill in the start date of the lease/rental agreement.

Note: If you are the tenant, enter a return address for the security deposit.

Step 4 – After the notice has been served, fill out the “Proof of Service” section. Select the service method that was used, and then enter the date/time of service. Print, sign, and date your name in the input fields at the bottom of the section.

Note: Make several copies of the completed notice to save for your records.
