New Mexico 3 Day Notice to Pay or Quit | NonPayment of Rent
The New Mexico three (3) day notice to pay or quit, known as ‘Form CV-105′ in accordance with Section 47-8-33(D), is required to be served to tenants who have failed to pay rent (in accordance with the lease/rental agreement). The notice informs the tenant that they must pay the past due amount within three (3) days of being served, and that if they do not pay the back rent by the end of the third day, the landlord can file an eviction lawsuit (known in New Mexico as a “Petition by Owner for Restitution”).

How to Write
Step 1 – Enter the name of the tenant in the “To” field at the top of the notice, and then enter their mailing address.
Step 2 – Write the full address of the rental property (street, apartment/unit number, city, county, ZIP).
Step 3 – Fill in the amount that is owed, and then select which forms of payment are accepted (cash, check, money order, etc.). Date the form and then sign your name.
Step 4 – Complete the “Service of Notice” section after the notice has been served. Select the method of service, and then enter the time/date of service.
Note: In the “By” field, the person who served the notice must print/sign their name.
