The Missouri month-to-month termination letter, pursuant to Section 441.060, is used to inform a month-to-month tenant of the landlord’s intention to terminate the lease/rental agreement. No reason is necessary to terminate a month-to-month (or “at-will”) tenancy, however the termination cannot be discriminatory or retaliatory in nature. The tenant must receive at least thirty (30) days notice before the landlord can terminate the agreement. The lease termination letter provides this notice to the tenant, which is a legally required step of the eviction process.
How to Write
Step 1 – Put the current date (DD/MM/YYYY) and full address of the rental property (street, city, county, state, ZIP) in the top line of the notice. Enter the name of the tenant in the blank “To:” field.
Step 2 – If you are the landlord, check the first box off and then enter the (start) date of the lease. If you are the tenant, select the second box. Enter the lease start date and then put a return address for the security deposit.
Step 3 – At the bottom of the notice is the “Proof of Service” section. Fill this part out after the notice has been served. Select the delivery method, enter the date of delivery/service, and then sign/print your name.
