The Idaho thirty (30) day notice to quit, in conjunction with Statute 55-208, is used by landlord or tenant to inform one another of their intention to terminate the lease/rental agreement. The thirty (30) day notice form is only applicable to month-to-month or “at-will” tenancies. If the tenant fails to vacate the rental property within the thirty-day time period, the landlord can begin the eviction lawsuit process in court.
Note: Although landlords do not need a specific reason to terminate the lease/rental agreement, they cannot terminate it due to the gender, age, marital status, etc. of the tenant(s) (i.e. they cannot use “retaliatory/discriminatory” eviction standards).
How to Write
Step 2 – Enter the notice date, and rental unit address at the top of the form.
Step 3 – If you are the landlord notifying the tenant, check the first box. Enter the date of the lease. If you are the tenant informing the landlord, check the second box and enter the lease date.
Step 4 – The “Proof of Service” section at the bottom of the form should be filled out before/after serving the notice to the tenant/landlord. Select the delivery method that was used (by checking the corresponding box) and then enter the date that the notice was served. Sign and print your name at the bottom, and then enter the service date.
