Delaware 60 Day Notice to Quit | Month to Month Tenancy

The Delaware sixty (60) day notice to quit, in regards to § 5106, is served to tenants to notify them of the termination of their month-to-month lease/rental agreement. Delaware requires that month-to-month tenants must be notified via personal or mail delivery, at least sixty (60) days prior to the date of termination. The sixty (60) day notice period officially begins on the first day of the month following the date of initial notice.

How to Write

Step 1 – Next to the “Notice Date:” field, enter the current date (DD/MM/YYYY). In the input field next to it (“Address”) enter the full address of the rental unit.

Step 2 – In the “To:” field enter the full name of the tenant. In the section below the “To:” field check the first box and enter the lease date.

Step 3 – Enter your business address in the “Security Deposit” field.

Step 4 – The “Proof of Service” should be filled out after serving the notice to the tenant. Enter the date that the notice was served, and select the service method from the list of options. Sign and print your full name at the bottom of the form, and then enter the date of service.
